Exco Capital (Pty) Ltd is committed to transparency and to facilitating lawful access to records in accordance with the Promotion of Access to Information Act 2 of 2000, as amended (“PAIA”).

This page explains how to request access to a record held by Exco Capital.

To request access to a record held by Exco Capital:

1. Download and complete Form 2: Request for Access to a Record.
2. Provide sufficient information to identify the record requested.
3. State the right you wish to exercise or protect.
4. Explain why access to the record is required to exercise or protect that right.
5. Attach proof of identity and, where you are acting for another person or organisation, proof of your authority.
6. Email the completed and signed form, together with the supporting documents, to support@excocapital.com.

Exco Capital may request additional information where this is reasonably necessary to identify the record, verify the requester’s identity or process the request.

Prescribed request, search, reproduction or access fees may apply. Where a fee is payable, Exco Capital will notify the requester before proceeding.

Exco Capital will ordinarily respond within the period prescribed by PAIA. Access may be granted, granted in part or refused on one or more of the grounds recognised by PAIA.

A requester may submit a complaint to the Information Regulator where, for example:

• a PAIA request has been refused;
• Exco Capital has not responded within the prescribed period;
• the requester disputes a fee;
• the requester disputes the form in which access was provided; or
• the requester is otherwise dissatisfied with the handling of the request.

A complaint should ordinarily be submitted only after a PAIA request has first been made to Exco Capital using Form 2.

• records that may be available without a formal PAIA request;
• the procedure for requesting access;
• applicable fees and response periods;
• possible grounds for refusing access;
• Exco Capital’s processing of personal information; and
• available remedies.

Submitting a request does not mean that access will be granted automatically. Access remains subject to PAIA, POPIA, legal privilege, confidentiality obligations, intellectual property rights, third-party rights, and the statutory grounds for refusal.
