Exco Capital Terms of Service

Welcome to Exco Capital ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our website www.excocapital.com (the "Site") and the services provided therein (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

By registering as an Opportunity Broker or Business Associate, or by otherwise accessing or using our Services, you agree to comply with and be legally bound by these Terms and our Privacy Policy. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Exco Capital provides specialized business development services aimed at empowering African businesses to overcome growth barriers and achieve their full potential. Our Services include:

• Connect: Facilitating introductions to prospective strategic partners and business opportunities.
• Facilitate: Assisting in capturing opportunities and creating strategic partnerships.
• Advise & Consult: Offering capital-raising strategies and consulting services for implementation.
• Invest: Providing funding and connecting businesses with additional investors and funders.

4.1 Eligibility

You must be at least 18 years old to register for our Services. By registering, you represent and warrant that you meet this eligibility requirement.

4.2 Registration Process

To access certain features of our Services, you must register by providing accurate and complete information as prompted by the registration form, including your name, phone number, and email address.

4.3 No Obligation

When you register, there’s no obligation on you. Registration allows you to explore our Services and benefits without any commitment.

4.4 Annual Subscription Fee

Exco Capital operates on a no-commission basis. We do not take or receive commissions from referrals given to independent business brokers or associates. Instead, we require an annual subscription fee of $100. By subscribing, you agree to pay the specified fee and any applicable taxes.

Exco Capital does not take or receive commissions from referrals made to independent business brokers or associates. Our revenue model is solely based on the annual subscription fee as outlined in Section 4.4.

As a user of our Services, you agree to:

• Provide accurate, current, and complete information during registration and maintain the accuracy of such information.
• Maintain the confidentiality of your account credentials and are responsible for all activities that occur under your account.
• Comply with all applicable local, state, national, and international laws and regulations.
• Not use the Services for any unlawful or prohibited activities.

7.1 Ownership

All content, features, and functionality on the Site, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Exco Capital or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 Limited License

Exco Capital grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and Services for your personal or internal business purposes, subject to these Terms.

We use cookies and similar tracking technologies to track activity on our website and store certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our website.

To the fullest extent permitted by law, Exco Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party.
• Any defamatory, offensive, or illegal conduct of any third party.

Exco Capital reserves the right to terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services.

As Exco Capital operates internationally, your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. By providing your information to us, you consent to such transfers.

These Terms shall be governed and construed in accordance with the laws of of the Republic of South Africa, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within South Africa to resolve any disputes.

Exco Capital reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

Your use of the Services is also governed by our Privacy Policy, which addresses how we collect, use, and protect your information.

Our services are not directed to anyone under the age of 18.
